1. Why we have this policy
Unsolicited messaging harms recipients, damages trust in messaging as a channel, and puts Sendly's and our upstream partners' standing with mobile networks and regulators at risk. This policy sets out the consent and opt-out rules every message sent through Sendly must follow, consistent with Nigeria's Do-Not-Disturb (DND) framework for unsolicited communications.
2. Transactional vs. promotional messages
Not every message carries the same obligations. Sendly distinguishes between two broad categories, and you must classify your messages honestly:
- Transactional messages — OTPs, order/delivery updates, account or security alerts, appointment reminders, and similar messages sent as part of a service the recipient already requested or an existing relationship. These may generally be sent without a separate promotional opt-in, but must still be accurate and not used as a disguise for marketing content.
- Promotional messages — marketing, offers, announcements, and other messages intended to advertise or promote a product or service. These require the recipient's prior consent and are subject to DND opt-out rules below.
3. Consent requirements
- You must have a lawful basis — such as explicit opt-in, an existing customer relationship, or a legal obligation — to send a message to any recipient.
- You must be able to demonstrate, on request, how and when a recipient consented to receive promotional messages from you.
- You may not message numbers obtained through purchased or scraped lists without independently verifying consent.
- Consent obtained for one purpose (e.g. OTPs) does not extend to a different purpose (e.g. marketing) unless the recipient separately agreed.
4. Opt-out and Do-Not-Disturb (DND)
- Every promotional message must give the recipient a clear way to opt out (for example, a "reply STOP to unsubscribe" instruction).
- You must honor an opt-out request without delay and must not message that recipient promotionally again.
- You are responsible for respecting Nigeria's DND registry and any recipient who has separately registered a number as not wishing to receive promotional communications.
- Sendly may provide tooling to help you manage opt-outs, but the underlying legal responsibility to honor them is yours as the sender.
5. Volume and pattern monitoring
We monitor sending patterns (volume, recipient complaint rates, opt-out rates, and delivery/rejection rates from our upstream partners) to detect likely spam or non-consensual messaging. Accounts showing patterns consistent with spam may be rate-limited, have campaigns held for review, or be suspended pending investigation.
6. Consequences of violation
Violating this Anti-Spam Policy is a violation of our Acceptable Use Policy and our Terms of Service, and may result in message holds, Sender ID suspension, account suspension or termination, and forfeiture of related wallet funds where permitted by law, in addition to any liability you may have to the recipient or under applicable law.
