1. How Sendly delivers messages
Sendly.ng is a messaging platform product of New Generationweb Solution. Messages sent through Sendly are delivered to Nigerian mobile networks through our licensed telecommunications and value-added service (VAS) partners, who hold the regulatory authorizations required to terminate traffic on those networks. Sendly builds and operates the platform — your dashboard, wallet, Sender ID workflow, API, and delivery reporting — on top of that licensed infrastructure, so you never need to manage a separate relationship with each individual partner.
2. Regulatory framework we operate within
Messaging sent through Sendly is subject to the applicable rules of Nigerian telecommunications and data protection regulators, including obligations relating to:
- Sender ID registration and approval, before a named Sender ID may be used.
- The Do-Not-Disturb (DND) framework governing unsolicited promotional messaging.
- Consent-based messaging — a recipient must have a lawful basis to be messaged.
- Personal data protection under the Nigeria Data Protection Act, 2023.
These obligations are enforced across the whole chain — Sendly, our upstream partners, and you as the sender each have a role to play, and each of us is expected to meet the standards that apply to that role.
3. Your obligations as a customer
- Only send messages you have a lawful basis to send, per our Anti-Spam Policy.
- Only use a Sender ID that has actually been approved for your account.
- Provide accurate business and identity information when requested for compliance or Sender ID review.
- Cooperate with any compliance inquiry Sendly raises about your account's messaging activity.
- Not use Sendly to route messages on behalf of a third party who has not agreed to these policies themselves.
4. Monitoring and audit
To meet our own obligations to regulators and upstream partners, we monitor account activity for patterns consistent with non-compliant messaging (unapproved Sender ID use, high complaint or opt-out rates, content that appears to violate our policies), and we keep audit records of Sender ID decisions, wallet transactions, and message delivery outcomes. We may request additional information from you as part of this monitoring.
5. What happens if a compliance issue is found
Depending on severity, we may: request corrective action, hold affected messages, suspend the relevant Sender ID, suspend or terminate the account, or report the matter to the relevant regulator or law-enforcement body where required. Where a regulator or upstream partner requires us to take a specific action against an account, we will comply even where that action is more restrictive than our own policies would otherwise require.
6. Accuracy of this policy
We do not claim to hold, and this policy does not represent Sendly as holding, a direct telecommunications operating license from the Nigerian Communications Commission (NCC). Sendly's role is as a technology platform operating through licensed upstream partners, as described above; this policy will be updated if that relationship changes.
